बहराइच दंगों और कर्नाटक हाईकोर्ट के फैसले पर मुस्लिम मजलिसे मुशावरत की प्रतिक्रिया

नफरत और हिंसा की राजनीति अस्वीकार्य, देश के सामाजिक ताने-बाने के लिए गंभीर खतरा: फिरोज अहमद एडवोकेट नई दिल्ली: मुस्लिम संगठनों और प्रतिष्ठित हस्तियों के परिसंघ ऑल इंडिया मुस्लिम मजलिस ए मुशावरत (AIMMM) ने पुलिस के संरक्षण में बहराइच के मेहसी और अन्य जगहों पर रविवार से चल रहे दंगों पर गहरी चिंता व्यक्त की है। मुशावरत के अध्यक्ष श्री फिरोज अहमद एडवोकेट ने कहा कि सांप्रदायिक नफरत और हिंसा की राजनीति से देश का सामाजिक ताना-बाना गंभीर रूप से खतरे में पड़ गया है। उन्होंने इसके लिए सीधे तौर पर उत्तर प्रदेश की जोगी सरकार को जिम्मेदार बताते हुए मुख्यमंत्री के इस्तीफे की मांग की है। उन्होंने कहा है कि यूपी पुलिस दंगाइयों का साथ दे रही है, तस्वीरों और वीडियो में देखा जा सकता है कि अल्पसंख्यक आबादी पर हमला करने वाली भीड़ में कभी पुलिस आगे आगे चल रही है और दंगाई पीछे चल रहे हैं, तो कभी दंगाई पीछे – पीछे चल रहे हैं और पुलिस आगे आगे चल रही है। श्री अहमद ने कहा कि बहराइच में जो हिंसा की घटनाएं हुई हैं, वे आकस्मिक नहीं थीं, वे योजनाबद्ध थीं, पहले दंगा हुआ और अब निर्दोष लोगों पर अत्याचार किया जा रहा है। सुप्रीम कोर्ट के वरिष्ठ वकील श्री अहमद ने कर्नाटक हाईकोर्ट के उस फैसले को बहुत दुर्भाग्यपूर्ण बताया है, जिसमें मस्जिद में घुसकर जयश्री राम के नारे लगाने वाले आरोपियों के खिलाफ दर्ज अपराध के मामले को निरस्त कर दिया गया, जबकि उन्होंने सामाजिक सौहार्द और कानून व्यवस्था को नष्ट करने की साजिश रची थी। उन्होंने कहा कि कोर्ट की यह टिप्पणी ज्यादा अफसोसजनक है कि मस्जिद के अंदर जयश्री राम का नारा लगाने से किसी की धार्मिक भावनाओं को ठेस नहीं पहुंचती। उन्होंने कहा कि पुलिस और जजों के इसी व्यवहार से उपद्रवियों के हौसले बुलंद होते हैं। दुर्गा पूजा जुलूस के दौरान मुस्लिमों के घर पर चढ़कर हरा धार्मिक झंडा हटाने, भगवा झंडा लहराने और जुलूस के साथ डीजे पर भड़काऊ गाने बजाने से इलाके में दंगा भड़क गया, क्योंकि पुलिस ने उपद्रवियों को रोकने की कोशिश नहीं की। उत्तर प्रदेश सरकार और प्रशासन दंगों पर काबू पाने में अभी भी नाकाम है, लगातार तीसरे दिन अल्पसंख्यक इलाकों पर हमले, गुरुवार को फर्जी मुठभेड़ में पुलिस द्वारा मुस्लिम युवकों को गंभीर रूप से घायल कर दिया गया और अल्पसंख्यक समुदाय के लोगों को एकतरफा तौर पर मौत के घाट उतारा और उन पर हिंसा की जा रही है। बहराइच के मेहसी तहसील के महराजगंज में रविवार शाम को भड़के दंगे गांवों तक फैल गए और उपद्रवियों ने पूरे दिन अल्पसंख्यक समुदाय के घरों, दुकानों और पूजा स्थलों को बेरोकटोक निशाना बनाया। उपद्रवी समूह के रूप में आसपास के इलाकों में सक्रिय हैं और अभी भी हमले कर रहे हैं क्योंकि उन्हें पुलिस और सरकार का संरक्षण प्राप्त है। मुशावरत के अध्यक्ष ने कहा कि जब तक आदित्यनाथ सत्ता में हैं, यह सिलसिला नहीं रुक सकता। स्थानीय निवासी पुलिस और प्रशासन की भूमिका की आलोचना कर रहे हैं लेकिन उनकी चीख-पुकार कोई नहीं सुन रहा है। जब दंगाइयों का समूह तोड़फोड़, आगजनी और लूटपाट करके गांव से चला जाता है, तो पुलिस आती है और उत्पीड़ित लोगों को निशाना बनाती है। पुलिस ने स्थिति पर काबू पाने का दावा किया है लेकिन सच्चाई यह है कि दंगाइयों को लूटपाट की खुली छूट मिल गई है और पुलिस भी पीड़ितों पर जुल्म ढा रही है। पूरे प्रभावित इलाके में पुलिस बल तैनात कर दिया गया है। एसटीएफ कमांडो और सीआरपीएफ के जवानों ने मोर्चा संभाल लिया है लेकिन स्थिति तनावपूर्ण और विस्फोटक बनी हुई है। रविवार को दुर्गा पूजा मूर्ति विसर्जन जुलूस के दौरान मुस्लिम इलाकों से गुजरते समय डीजे पर बेहद भड़काऊ गाने बजाए गए और फिर जबरन हरा झंडा उतार कर मुसलमानों के एक घर पर भगवा झंडा फहरा दिया गया। इसके बाद हिंसा भड़क उठी। यह सिलसिला अगले दो दिनों तक जारी रहा। फखरपुर, कैसरगंज, गायघाट और शहर के अलग-अलग इलाकों में मूर्ति विसर्जन जुलूस के दौरान उपद्रवियों ने हथियारों का प्रदर्शन किया और एक धर्मस्थल में आग लगा दी, मदरसों और इबादतगाहों पर पथराव किया परामर्शदात्री समिति का मानना है कि भारत के राष्ट्रपति और मुख्य न्यायाधीश को इस मामले में हस्तक्षेप करना चाहिए तथा एक उच्च स्तरीय जांच गठित करनी चाहिए ताकि पीड़ितों को इंसाफ मिल सके।
AIMMM on Bahraich riots and Karnataka High Court verdict:

The politics of hatred and violence is unacceptable, posing serious threats to the social fabric of the country: Feroze Ahmed Advocate New Delhi: The All India Muslim Majlis e Mushawarat (AIMMM), the only confederation of Muslim organizations and personalities of eminence, has expressed deep concerns over the riots that have been going on since Sunday in Mehsi and other places of Bahraich with the support of the police. Mr. Feroze Ahmed Advocate, president of AIMMM said that the social fabric of the country has been seriously under danger by the politics of communal hatred and violence. Calling the Jogi government of Uttar Pradesh directly responsible for this, he has demanded the resignation of the Chief Minister. He has said that the UP police is supporting the rioters, in the pictures and videos it can be seen that in the crowd attacking the minority population, sometimes the police are moving forward and the rioters are walking behind, while sometimes the rioters are walking behind and the police are moving forward. Mr. Ahmad said that the acts of violence that took place in Bahraich were not accidental, they were planned actions, first there was a riot and now the innocent people are being oppressed. Mr. Ahmad a senior Supreme Court lawyer has described the decision of the Karnataka High Court as very unfortunate, in which the case of crimes filed against the accused persons who entered a mosque and shouted Jaishree Ram slogans was quashed, while they had conspired to destroy social harmony and law and order. He said that this remark of the court is more regrettable that chanting Jaishree Ram inside the mosque does not hurt anyone’s religious sentiments. He said that miscreants are encouraged by the same behavior of police and judges. During the Durga Puja procession, climbing a Muslim house and removing a green religious flag, waving a saffron flag and playing inflammatory songs on a DJ along with the procession led to riots in the area as the police chased the miscreants did not try to stop him. UP government and administration are still unable to control the riots, attacks on minority areas for the third day in a row, Muslim youths were seriously injured by the police in a fake encounter on Thursday and people belonging to the minority community were unilaterally killed and being subjected to violence. The riots that broke out in Mehrajganj of Mehsi tehsil of Bahraich on Sunday evening spread to the villages and miscreants unabatedly targeted houses, shops and places of worship of the minority community throughout the day. The miscreants have been active in the surrounding areas in the form of groups and are still carrying out attacks as they have the support of the police and the government. President of AIMMM said that this process cannot stop as long as Adityanath is in power. Local residents are criticizing the role of the police and administration but no one is listening to their cries. When the group of rioters goes to the village by vandalizing, arson and looting, then the police come and they target the oppressed poeple. Internet services are down in the district. The police claimed to have brought the situation under control But the truth is that the rioters have got free rein to loot and the police are also oppressing the victims. Police force has been deployed in the entire affected area. STF commandos and CRPF jawans have taken the front but the situation remains tense and explosive. During the Durga Puja idol immersion procession on Sunday, very provocative songs were played on the DJ while passing through the Muslim areas and then the green flag was forcibly removed and the saffron flag was hoisted on a house of Muslims. After that, violence erupted. The series continued for the next two days. During the idol immersion procession in Fakhrpur, Qaisarganj, Gayghat and different areas of the city, miscreants displayed weapons and set fire to a shrine, Stones were pelted on madrassas and places of worship, Muslim shops were targeted at Ganj Talab Market adjacent to the city’s Chowk Bazaar, vehicles were set on fire and the police were either complicit or bystanders. The consultation believes that the President of India and the CJI should intervene in this matter and should be setup a high level enquiry.
Mushawarat condemns Derogatory Remarks against the Prophet and demands arrest of serial offender Narsinghanand arrest under UAPA

New Delhi: The All India Muslim Majlis-e-Mushawarat (only confederation of prominent Muslim organisations and individuals) has strongly condemned the derogatory remarks made by the so -called Swami Yati Narsinghanand against the Prophet of Islam (peace and blessings be upon him). AIMMM, the oldest on federation of Muslim organizations says that the derogatory remarks uttered by this foul-mouthed individual represent extreme provocation and are completely intolerable and will create unrest in the country. President of the AIMMM, Feroze Ahmed Advocate, emphasized that the government must immediately arrest this serial offender under UAPS prosecute him, and ensure he is punished. Mr. Feroze Ahmad further added that allowing him to roam freely is dangerous for peace and tranquility, and such an individual has no place to roam freely in any civilized society and needs to be put behind bars. Psychopath Narsinghanand repeatedly causing deep offense to millions of people in the country and abroad, and his repeated nonsensical utterances are endangering peace and security in the country and creating bad image for the country across the globe. The President of the AIMMM stated that Muslims believe in one God, and idol worship is considered a grave sin in Islam, yet Islam prevents its followers from insulting the holy figures of any other religion and does not allow the hurting of anyone’s sentiments. The Qur’an even prohibits speaking ill of the deities worshipped by non-Muslims. He further stated that the blasphemy of Narsinghanand is the act of a vile and disrespectful individual, and we must take appropriate legal action against this foul-mouthed person. Mushawarat president emphasised that Muslims, wherever they lives, should educate and introduce to others about the noble character of the Prophet Muhammad (peace and blessings be upon him) and explain how the enemies of freedom and equality are distressed by the Prophet’s teachings by indulging in distorting Prophet’s character to prevent the oppressed from uniting and adopting his principles of justice and equality.
Amendment in Wakf Act is unacceptable: Muslim Majlis-e-Mushawarat

New Delhi: The All India Muslim Majlis e Mushawarat (AIMMM) today said that the proposed amendments in the Wakf Act is not acceptable to the Muslims. This is totally in contravention of India’s secular and democratic norms and hurts the sentiments of over 220 million minorities. It is the duty of all democratic loving parties to oppose the proposed and frustrate the government attempt to get its passed. Wakf properties have been donated by our forefathers for socio-economic welfare development of the minorities. land and properties also given to various religious place and dargah. The purpose of these amendments seems to usurp or handover these properties to some interested groups and individuals. the government is only a regulatory authority and no attempt should be made to dilute powers of the Wakf Boards. The AIMMM is ready to seek legal remedy from the apex court if these amendments get approval of the Parliament. There are 30 Wakf Boards in the country and they manage more than 8 Lakh moveable and immoveable properties. The Union cabinet has given its approval to these amendments last Friday. Concerns over reduction in budget allocation of welfare

AIMMM president Mr. Feroze Ahmad Advocate said that Nirmala Sitharaman has disappointed the minority communities New Delhi: All India Muslim Majlis e Mushawarat, the only confederation of Muslim organizations and personalities of eminence, expressed concerns over the complete neglect of the minority communities in the general budget and said that even during the budget speech, no mention has been made by Finance Minister Nirmala Sitharaman about the development of minorities. AIMMM president Mr. Feroze Ahmad Advocate said that the National Democratic Alliance government presented its eleventh full budget in a row. During the general election and even before the budget presentation the unemployment, inequality and inflation were the major issues that have also impacted the results of the Lok Sabha Elections 2024. When we talk about budget allocation for marginalized communities such as Minorities, Scheduled Castes, Scheduled Tribes, Disable Persons, gender and children, the situation is not encouraging in this budget as well as Dr. Jawed Alam Khan, member of the organization and expert of the socio-economic affairs said “there is no serious efforts has been made to address the inflation and unemployment related challenges in this budget. AIMMM emphasizes that despite the low development indicators of minorities, there was a drastic decline of 38 per cent in the previous year’s budget (a decrease of Rs 1,913 crore from 2022-23) for the MoMA. For the last few years, MoMA has not been able to utilise funds against the BE. The ministry spent Rs 3,998.57 crore out of the BE of Rs 5,029.10 crore and Rs 4,325.24 crore out of Rs 4,810.77 crore in 2020-21 and 2021-22, respectively. Actual expenditure of Rs 802.69 crore was incurred out of the Rs 5,020.50 crore outlay in 2022-23. When we talk about budget allocation for marginalized communities such as Minorities, Scheduled Castes, Scheduled Tribes, Disable Persons, gender and children, the situation is not very encouraging in this budget. It is recommended that the total budget allocation for MoMA should be significantly increased, given the level of deprivation in the educational attainment of minorities. All the scholarship schemes should be made demand-driven, along with additional financial resources to enhance unit costs and revision in the eligibility criterion related parental income. The schemes which have been discontinued should be revived. Under the 15 Point Programme, resource allocation should be made in line with the diverse needs of minority communities across different sectors.
Appeal Against the biased Order of Inquiry and Intervention in Madrasahs by the state government of Uttar Pradesh and the Child Rights Commission of India

Date:26th July 2024 To, Madam Draupadi Murmu The Hon’ble President of India, Rashtrapati Bhavan, New Delhi – 110004 Subject: Appeal Against the biased Order of Inquiry and Intervention in Madrasahs by the state government of Uttar Pradesh and the Child Rights Commission of India Respected Hon’ble Madam President, On behalf of the members of All India Muslim Majlis e Mushawarat (AIMMM), the only confederation of Muslim organizations and personalities of eminence, I take the privilege of writing to you with a deep sense of concern regarding the recent directives issued by the Chief Secretary of Uttar Pradesh and the Child Rights Protection Commission of India to inquire into the functioning of Madrasahs in the state of Uttar Pradesh and transition their students to government schools. The directive also says, “the Hindu Students should not be there”. This directive, we believe, is an unwarranted and unconstitutional interference in the religious and educational rights of the Muslim minority community. The right to establish and administer educational institutions of our choice is a fundamental right guaranteed under Article 30(1) of the Constitution of India. This provision ensures that minorities, whether based on religion or language, have the absolute right to establish and administer educational institutions to preserve and transmit their heritage, culture, and religion to their children. Madrasahs play a crucial role in the holistic development of Muslim children, providing not only religious education but also contributing to their moral and ethical upbringing and literacy rate of the nation. The institutions have integrated modern education curricula, ensuring that their students receive a balanced Universal Elementary education. The sudden and unilateral move to transition students to government schools disregards the efforts and contributions of these institutions and violates the community’s right to educate their children in accordance with their religious beliefs. This system of free education committed to weaker section of the community, which came into existence by self-determined social responsibility of Muslims, has been rendering valuable services to the nation for more than a thousand years, and a large part of it is also a big and unparallel successful example of Public Private Partnership. Right now, according to the latest analysis of available data, more than one crore male and female pupils are studying in the madrasas across the country and lakhs of them are in the state of UP. This institution of learning (Madrasahs) carries the burden of early leaning of the Children of the nation without any cost and any kind of discrimination. There are a massive number of children admitted to Madrasahs from weaker sections of other communities from the remote areas of the country. The central government SPQEM reports find that there is the children’s attendance visibly more than government schools and teachers are more punctual, responsible and attention paying to the students. It is pertinent to mention that overwhelming number of students enrolled in the Madrasahs are not only from the BPL families, but they also are admitted due to non-availability of the government primary schools in the immediate neighborhood. Similarly, thousands of Muslim and other religion children study in Vedic Pathshalas, Shishu Mandir and Christian missionary schools. Only targeting the Madrasahs is exposing the intention. The education system of the state is very poor, more than 100 Shiksha Mitras have committed suicide due to non-payment of salary. Targeting the Madrassas will have very bad effects on the state of education in the state. There are a massive number of part-time informal learning centers in the country, out or in the premises of Masjids, the government of Uttar Pradesh is spreading sensation by counting them as madrasahs. Children of these institutes are also admitted to local schools / formal institutes as well as big seminaries (Darul-uloom) give them admission after completion of primary education (UEE). A best example of the contribution of these institutions in the field of education is Kerala, which has the highest position in the country in terms of health care, poverty alleviation and basic education in the Social Development Index, and UNICEF and the WHO place first the state for Child Care. In achieving this, the contributions of these informal part-time learning centers are considered very important. The states should seek their cooperation and not harass them unconstitutionally, while the Right to Education Act has bound the Center and the states to provide quality education to the children in the educational institutions of their choice and Religious Learning are protected by the law. We would like to highlight the following points for your kind consideration: Constitutional Rights: The directive undermines Article 30(1) which guarantees minorities the right to establish and administer educational institutions of their choice. This act can be perceived as an attempt to erode the educational autonomy of the Muslim community. Inclusive Development: The government’s focus should be on enhancing the quality of education across all types of institutions, including Madrasahs, rather than dismantling them. Constructive engagement with Madrasah authorities to ensure quality education would be a more inclusive and effective approach. Therefore, we earnestly request your esteemed office to intervene in this matter and direct the Uttar Pradesh government to withdraw the said directive. We urge you to safeguard the constitutional rights of the Muslim minority and ensure that the principles of justice, equality, and secularism are upheld. We are confident that under your leadership, the rights and freedoms guaranteed by our Constitution will be protected, ensuring that all communities can coexist and contribute to the nation’s progress in harmony. Dear Sulaiman Sahab It has come to our knowledge that since last one months, you have been indulging in claiming to be Vice-President of All India Muslim Majlis -e- Mushawarat (AIMMM) launched in 1964 and issuing statements to press impersonating as its Vice-President. In the last elections of the AIMMM held in 2022-2023 for the tenure of 2023-2027, in which you had yourself participated as a voter, a new team the office bearers were elected in which the eligible voters of AIMMM elected me as president along with 25 members of the Markazi Majlis-e-Amla of AIMMM and there is no provision of elections of any office bearers other than for these 26 posts. You are fully aware that the constitution of AIMMM clearly gives power under Article 8 2(a) to the president to appoint the other office bearers, including the vice president. After assuming charge of the office of AIMMM on 2nd April 2023, the undersigned has appointed 3 Vice Presidents, Maulana Asghar Ali Imam Mehdi Salfi (Ameer, Markazi Jamiat Ahle Hadees Hind), Mr. E.T. Basheer Mohammad M.P (Muslim League) and Mrs. Abeda Inamdar (Educationist from Pune). Subsequently, again on dated 11.11.2023, exercising my powers to appoint vice president, I appointed Mr. Navaid Hamid as the fourth vice president. You were never appointed as any of the office bearer of All India Muslim Majlis -e- Mushawarat, and your impersonation as Vice-President is not only unethical but also illegal, which can invite civil and criminal proceeding against the fraudulent claim. It is pertinent to mention that you are also impersonating yourself as Professor to impress upon the common people for your wrongful gain, when you had never been Professor at any point of time with any university. It appears that you are intentionally and deliberately impersonating your self in different manner for your wrongful gain. You are requested to respond within 15 days as to why civil as well as criminal proceeding are not initiated against you beside disciplinary proceeding as per Dastoor of the Organisation. You are also advised to publicly apologize for your unethical acts with clear clarifications that you don’t hold any office post in All India Muslim Majlis -e- Mushawarat and you are not a Professor. All India Muslim Majlis e Mushawarat submission to the President of of India, interference in the activities of madrasas is against the constitution and law, please don’t allow the constitutional rights of Muslims, religious freedom, educational autonomy and comprehensive development to be violated, most children studying in madrasas belongs to the families live under poverty line and madrasas provide them education without any cost and discrimination, UP government is spreading sensation by counting non-formal part-time learning centers as Madrasahs New Delhi: In a letter addressed to the President of India, Draupadi Murmu, the All India Muslim Majlis e Mushawarat, the only confederation of Muslim organizations and personalities of eminence, has condemned the hostile actions of the government of Uttar Pradesh for harassing religious educational institutions in the state, sending madrassa children to schools and expelling non-Muslim children from madrassas. Expressing serious concern, AIMMM has requested them that interfering in the activities of madrasas is against the constitution and law, please do not allow the constitutional rights of Muslims, religious freedom, educational autonomy and comprehensive development to be violated. AIMM also requested the President of India that most of the children admitted here in Madrasahs are those who live below the poverty line and Madrasahs are centers of free education, food and accommodation. The Confederation of Muslim organizations pointed the Constitution guarantees religious and linguistic minorities to establish and run educational institutions of their choice, the Right to Education Act obliges the Center and the states to provide quality education in educational institutions of their choice and religious institutions are protected in this law. It says that these Madrasahs bear the burden of educating more than one crore children across the country and lakhs of them in the state of UP. More than one report of the central government’s Scheme for Providing Quality Education in Madrasas [SPQEM] has found that children’s attendance is higher here than in government schools and that Madrasah teachers are more punctual, responsible and attentive to students. The submission emphasizes “the number of students admitted to madrassas are not only from BPL families but also because of the absence of government primary schools in the nearby neighborhoods. Similarly, thousands of Muslim and other religion children study in Vedic Pathshalas, Shishu Mandir and Christian missionary schools. Only targeting Madrasahs is exposing the intention. The attention of the President has been sought on religious freedom, educational autonomy and comprehensive development and pointed that the condition of the education system in the state is very poor, more than 100 Shiksha-mitras have committed suicide due to non-payment and discouragement of madrassas will have a very bad effects on the state of education in the state. It should be clear that many other state governments of BJP are doing also this kind of arbitrariness, which causes deep concern and unrest in society. This petition asserts that the Uttar Pradesh government is spreading sensation by counting non-formal part-time learning centers as Madrasahs. It should be noted that in the list of more than 8,000 unapproved madrasahs that the UP government has released, many private tuition accommodations, part-time learning centers established inside mosques or elsewhere have also been included, even by their operators or the mosque administration didn’t name it.
